Terms of service

1. Scope

The general terms and conditions (hereinafter referred to as "GTC") apply to all orders and contracts (hereinafter referred to as "order") concluded via the Hi-Fish online shop (hereinafter referred to as "Hi-Fish.Shop").

The Hi-Fish.Shop reserves the right to change the terms and conditions. The version of the GTC applicable at the time of the order is decisive, which cannot be unilaterally changed for this order.

The customer acceptes the GTC with an order in the Hi-Fish.Shop. Should a provision of these terms and conditions be void, for whatever reason, the validity of the usual provisions remains unaffected. Verbal agreements require written confirmation.

 

2. Conclusion of contract 

By ordering the selected goods on the Internet, the customer makes a binding offer to conclude a purchase contract. The customer immediately receives a confirmation of the order by email.

If after the conclusion of the contract it turns out that the ordered goods cannot be delivered or cannot be delivered in full, the seller is entitled to withdraw from the entire contract or from a part of the contract. In the event of termination of the contract, the seller is not obliged to make a replacement delivery.

The offer is valid as long as it is visible in the online shop and / or stocks last. Price and range changes are possible at any time. The images (model, color, size, etc.) shown in advertising, brochures, in the online shop etc. are used for illustration and are non-binding. The specific information in the product description in the online shop is decisive.

The Hi-Fish.Shop is free to refuse orders in whole or in part without giving reasons. In this case, the clientele will be informed and any payments already made will be reimbursed. Further claims are excluded.

2.1. Pre-order

When ordering in advance, the purchase amount is due immediately. If the order cannot be delivered on the announced delivery date, the customer will be informed by email and the purchase amount will be refunded.

 

3. Prize 

The prizes are in Swiss Francs, including VAT. The decisive factor is the prize in the online shop at the time of the order. Ordered additional services such as delivery, gift packaging, etc. are listed separately in the shopping cart and on the invoice.

The Hi-Fish.Shop is entitled to change the prizes at any time, but undertakes to invoice the ordered goods at the prizes applicable when the order was placed. No price reductions and discounts are given without a special agreement.

For deliveries abroad, the approaches of the country of destination apply with regard to VAT and customs duties, i.e. the country of the respective recipient.

 

4. Delivery 

Delivery is made by post or a standard courier service.

4.1. Delivery region

The Hi-Fish.Shop delivers to Switzerland, the Principality of Liechtenstein and the EU. For the time being, deliveries to other countries will only be made on individual request.

4.2. Delivery of alcoholic beverages

Alcoholic beverages are only delivered within Switzerland and the Principality of Liechtenstein. The Hi-Fish Beer is delivered by Brauerei Locher AG in Appenzell.

4.3. Shipping costs

Unless otherwise stated, delivery to Switzerland, the Principality of Liechtenstein and the EU is free of charge. Otherwise, the delivery costs noted in the shopping basket apply and are borne by the customer.

4.4. Part deliveries

If an order contains items that are in stock and also items that are only available at a later date, the items will be dispatched in instalments. Delivery costs may be charged for partial deliveries that are below a purchase amount of CHF 70.00, unless free delivery is indicated.

4.5. Delivery time

All items will be delivered immediately, if available from stock. When ordering in advance, the delivery time applies, which is noted for the item in the online shop.

The delivery time within Switzerland is usually 3 working days, to other countries depending on the specifications. A delay in delivery cannot lead to compensation, discounts or cancellation of the order. If an article is not available at short notice, customers will be informed by email about the expected delivery time.

In the event of delivery delays, e.g. due to force majeure, traffic disruptions and disposal by a high hand, as well as other events for which we are not responsible, no claim for damages can be raised against us.

 

5. Warranty 

The customer is obliged to check the delivered goods immediately after receipt of the delivery and to notify the seller immediately in writing of any defects within 3 days for which the seller guarantees by email: info@hi-fish.com. If transport damage to the goods is found, the recipient must immediately request a damage form from the post office.

5.1 Returns

Returns to the seller are made at the expense and risk of the customer. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects, to the return address specified by the seller. The Hi-Fish webshop reserves the right to request proof of the defect.

The Hi-Fish.Shop can provide the guarantee either by partial or complete replacement with an equivalent product, credit up to a maximum of the sales price at the time of the order.

There is no general right of return of defect-free and correctly delivered products.

 

6. Payment 

All prices quoted are final prices. Payments must be made in Swiss francs or in the currency displayed in the webshop.

Payment on delivery is possible by:

• Credit card (American Express, Visa, Mastercard)

• Debit card (Visa, Mastercard)

• Mobile payment (Apple Pay, Google Pay)

• Payment service (PayPal, Union Pay, Twint)

6.1 Prepayment

In exceptional cases, advance payment can be made to the bank account.

The customer is obliged to pay the purchase prize immediately after conclusion of the contract by transfer to the account of the Hi-Fish.Shop. The account data will be sent to the customer via email after the contract has been concluded. If no transfer is made after 5 working days, the order will be considered null and void.

Delivery on account is not possible.

 

7. Minimum age for the consumption of beer and spirits 

With their order, customers confirm that they are 16 years of age (for alcoholic beverages) or have reached the age of 18 (for spirits) and are therefore legally entitled to purchase the alcoholic beverages offered. The Hi-Fish.Shop rejects any liability. If the Hi-Fish.Shop becomes aware that a customer violates this provision, the purchase contract loses its validity with immediate effect.

 

8. Limitation of liability 

A claim for compensation for items that are no longer available cannot be asserted.

Unless otherwise stated below, further claims by customers, regardless of the legal reasons, are excluded.

 

9. Copyright 

All third-party logos, pictures and graphics are the property of the respective companies and are subject to the copyright of the corresponding licensors. All graphics, photos, logos, texts, reports, scripts and programming routines shown on these pages, which are our own developments or have been prepared by us, may not be copied or otherwise used without our consent. All rights reserved.

 

10. Applicable court and jurisdiction 

Substantive Swiss law is applicable to the legal relationship between the Hi-Fish.Shop and the customer, with the exception of conflict-of-law norms and the Vienna Sales Law.

The place of jurisdiction for natural and legal persons is Winterthur in Switzerland.
